Terms of Service

By accessing or using any service operated by Chiller Tech Support LLC— including Torque CMS (torquecms.io), Motorsports Data (motorsportsdata.io), Clutch DMS (clutchdms.io), and this gateway (chillertechsupport.com) — you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy and Data Usage Policy, which are incorporated by reference.

If you are agreeing on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree, do not use the services.

Chiller Tech Support LLC operates the following platforms:

• Torque CMS — a field service management and contractor operations platform for HVAC and skilled trades companies.
• Motorsports Data — a racing career operating system providing telemetry, AI coaching, rider health monitoring, and team management tools.
• Clutch DMS — a dealership management system for powersports, marine, RV, and related recreational vehicle dealers.

Features, pricing, and availability are subject to change at any time. We will provide reasonable notice of material changes.

To access certain features you must create an account. You agree to provide accurate, complete, and current information and to keep your credentials confidential. You are responsible for all activity that occurs under your account.

• You must be at least 18 years old to create an account independently. Users under 18 on Motorsports Data require a parent or guardian account per our Privacy Policy (COPPA section).
• One person or organization may not maintain more than one free account. Sharing account credentials between multiple users is prohibited without a multi-seat subscription.
• You must notify us immediately of any unauthorized access to your account.

Chiller Tech Support LLC reserves the right to suspend or terminate accounts that violate these Terms, are fraudulent, or are inactive for an extended period.

Paid features are offered on a subscription basis. By subscribing, you authorize Chiller Tech Support LLC to charge your payment method on the applicable billing cycle.

• Flat-rate pricing. Subscriptions are priced per plan tier, not per seat, unless otherwise stated on the applicable product's pricing page.
• Annual plans. Annual subscriptions are billed upfront. Two months are provided at no charge compared to monthly billing.
• Cancellation. You may cancel at any time. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for unused portions of a billing cycle.
• Failed payments. If a payment fails, we will attempt to retry. Access may be suspended after 7 days of non-payment. Your data is retained for 30 days after suspension before permanent deletion.
• Price changes. We will provide at least 30 days' notice before changing subscription prices for existing subscribers.

All payments are processed by Square. Applicable taxes may be added based on your billing address.

You agree not to:

• Use any platform to violate any applicable law or regulation.
• Upload, transmit, or store content that is unlawful, defamatory, harassing, or infringes third-party intellectual property rights.
• Attempt to gain unauthorized access to any system, data, or account.
• Reverse engineer, decompile, or attempt to extract source code from any platform.
• Use automated bots, scrapers, or crawlers against any platform without prior written consent.
• Resell, sublicense, or white-label any service without a separate written agreement.
• Upload files or content for which you do not hold appropriate rights or permissions.

Violation of this section may result in immediate account termination without refund.

All software, designs, trademarks, logos, and content comprising the Chiller Tech Support LLC platforms are owned by or licensed to Chiller Tech Support LLC. These Terms grant you a limited, non-exclusive, non-transferable license to use the services as permitted herein. No ownership rights are transferred.

Your content.You retain ownership of all data, files, and content you upload (“Your Content”). By uploading, you grant Chiller Tech Support LLC a worldwide, non-exclusive, royalty-free license to store, process, display, and use Your Content solely to provide the services and, subject to your opt-out rights, to improve our AI models. This license terminates when you delete Your Content or your account.

Each platform ships with an embedded AI co-pilot powered by large language models. By using co-pilot features, you acknowledge:

• AI outputs are advisory, not professional advice. Do not rely solely on AI outputs for safety-critical decisions in field service, racing, or vehicle repair contexts.
• AI outputs may be inaccurate or incomplete. You are responsible for verifying any AI-generated recommendation before acting on it.
• Chiller Tech Support LLC is not liable for any losses arising from reliance on AI co-pilot outputs.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CHILLER TECH SUPPORT LLC DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHILLER TECH SUPPORT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.

IN NO EVENT SHALL CHILLER TECH SUPPORT LLC'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms or the services shall be resolved by binding arbitration administered under the rules of the American Arbitration Association in Salt Lake City, Utah, except that either party may seek injunctive relief in any court of competent jurisdiction.

Class action waiver. You agree to resolve disputes with Chiller Tech Support LLC on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Either party may terminate these Terms at any time. Upon termination, your license to use the services ends immediately. Sections covering intellectual property, disclaimers, limitation of liability, and governing law survive termination. Upon account termination, we will retain your data for 30 days before deletion, giving you the opportunity to export it.

Chiller Tech Support LLC may update these Terms from time to time. We will provide at least 14 days' advance notice of material changes via a platform notice or email to your account address. Continued use of the services after the effective date constitutes your acceptance of the revised Terms.
